A separate Federal Circuit appeal over Section 122's underlying legality remains pending and does not affect the sunset that already occurred. - Replacement (effective, not proposed): at the same moment, USTR's Section 301 forced-labor action took effect — a two-tier 10%/12.5% duty on roughly 60 economies (about 99.4% of US imports by value), broader than the single-rate, 46-country plan proposed in early-to-mid July. Lower-tier economies are those USTR found to have at least partial forced-labor import protections in place; the rest pay 12.5%. Section 301 has no statutory rate cap or time limit, unlike Section 122. EU-origin goods are unaffected and remain on the July 1 trade-deal 15% ceiling. Separately, President Trump said August 24, 2026 (social media post, no proclamation yet) that Canadian auto and steel tariffs would rise to 50% effective January 1, 2027, doubling the current 25% Section 232 auto rate — a distinct, not-yet-formalized action from this Section 338 tariff. - Brazil: +25% (Section 301, effective July 22, 2026) — 1,600+ HTSUS-line exemption annex (coffee, beef, orange juice, Brazil nuts, cocoa, iron ore, petroleum products, pharmaceuticals, civil aircraft); does not stack with Section 232 steel/aluminum - Patented pharmaceuticals + APIs (company-based, not country-based): 100% (Section 232, Proclamation 11020 signed April 2, 2026) — effective July 31, 2026 for the 17 companies named in Annex III, September 29, 2026 for everyone else not in Annex II/III; approved Commerce onshoring agreements reduce the rate to 20%; MFN pricing deals with HHS reduce it to 0% until January 20, 2029; generics, biosimilars, and orphan drugs exempt for now - China additional: +7.5-100% (Section 301) on electronics, machinery, EVs, solar, batteries - Polysilicon and derivatives (ingots, wafers, solar cells, solar modules): +15% (Section 232, announced August 6, 2026) plus minimum import prices ($21/kg polysilicon, $100/kg ingots/wafers, $0.22/W cells, $0.38/W modules) — effective December 4, 2026; separate from and stacks with existing Section 301 rates on Chinese-origin solar goods - Drones (UAS) and components: 100% on large (>25kg)/heavy/thermal-imaging drones + critical components, 25% on most consumer/hobby drones (Section 232, proclamation signed August 13, 2026) — effective September 3, 2026; additional 25% on further components effective February 9, 2027; EU/Japan/Liechtenstein/Korea/Switzerland/Taiwan capped at 15%, UK capped at 10%; China not on the reduced-rate list - USMCA: Canada and Mexico qualifying goods enter at 0% and are exempt from Section 122 ## Tariff Stacking — IMPORTANT Non-Stacking Rule - Section 122 (10%) does NOT stack on the metal content of Section 232 steel/aluminum/copper. A wholly-metal article is 50% total (Section 232 only), NOT 60%. Chinese wholly-steel is 75% (Section 232 50% + Section 301 25%), not 85%. - Section 232 tiers (effective April 6, 2026): 50% on wholly-metal articles; 25% on derivatives (applied to full customs value); 15% on certain metal-intensive equipment; 10% on foreign-made goods produced with U.S. metal. - Section 122 (10%) DOES apply to non-metal goods and to the non-metal portion of mixed articles; USMCA-qualifying goods are exempt from Section 122. - IEEPA reciprocal and fentanyl tariffs were struck down by SCOTUS (Feb 20, 2026) and are refundable — do NOT add them to the stack for current entries. ## Tariff Refunds — CAPE Program Status - CAPE Phase 1 live since April 20, 2026 (unliquidated / within-80-days entries); first ACH refunds paid May 11-12, 2026. - CAPE Phase 2 LIVE since June 29, 2026 (reconciliation entries + AD/CVD entries). - CAPE Phase 3 (finally-liquidated entries, ~$11.4B) was on track for late July 2026 but CBP told the CIT on August 25, 2026 it has delayed deployment to add validations — no new launch date set. On July 15, 2026 the CIT confirmed it will issue case-specific orders across ~3,700 individual IEEPA lawsuits directing CBP to reliquidate those plaintiffs' finally-liquidated entries — this relief currently runs only to importers who filed at the CIT, not non-litigants. - As of August 21, 2026: ~$132.5B accepted for CAPE processing (26.4M entries) and ~$106.6B of the $166B IEEPA pool certified and sent to Treasury for disbursement (about 64%), per CBP's update to the CIT — up from $100B certified as of August 4 (Freestyle World v. United States declaration). ~$1.7B (22,170 refunds) remains stuck on missing importer ACH banking details. - On August 10, 2026, DOJ filed its opening Federal Circuit brief seeking to vacate the CIT's order directing reliquidation of finally-liquidated IEEPA entries for the ~3,700 pending litigant cases; if vacated, non-litigant importers with finally-liquidated entries would need to sue individually rather than use an administrative path.
